These Terms of Service (the "Terms") govern your access to and use of DatsTheOne (the "Service"), a premium dating platform designed for adults aged 40 and over. By creating an account or otherwise using the Service, you agree to be bound by these Terms.
1. Introduction & Acceptance of Terms
DatsTheOne provides an online platform that helps members discover and connect with compatible partners. By accessing or using the Service, you confirm that you have read, understood and agreed to these Terms, together with our Privacy Policy. If you do not agree, you must not use the Service.
You must be at least 40 years old and legally able to enter into a binding contract in your jurisdiction to register for an account.
2. User Accounts & Registration
- You agree to provide accurate, current and complete information during registration and to keep it up to date.
- You are responsible for safeguarding your credentials and for any activity that occurs under your account.
- Plan Modifications: Subscription plans are fixed for the entire duration of the selected membership term. You cannot upgrade, downgrade, or alter your subscription plan until your current billing cycle expires.
- One account per person. Accounts are personal and may not be transferred, sold or shared.
- Notify us promptly at contact@datstheone.com of any unauthorized access or suspected breach.
3. Pause, Cancellation & Termination Accounts
- Pause & Cancellation: You may request to pause or cancel your subscription at any time during your active membership term. If you cancel, your subscription will remain active until the end of your current billing cycle, after which it will not renew. If you pause your membership, future billing and access will be temporarily held in accordance with your account settings.
- Termination & Data Deletion Notice: Upon the effective date of your account termination or deletion, your user profile and all associated personal information will be automatically and permanently deleted from our active systems.
4. Refund Policy
· All subscription purchases, renewals, and fees are non-refundable. No full or partial refunds, credits, or prorated adjustments will be issued for unused periods, plan downgrades, or early account terminations.
5. Acceptable Use Policy
You agree not to:
- Misrepresent your identity, age, photos or relationship status.
- Harass, abuse, intimidate or discriminate against other members.
- Publish unlawful, sexually explicit, hateful or violent content.
- Solicit money, advertise services or send unsolicited commercial messages.
- Attempt to access, scrape, reverse engineer or interfere with the Service or its underlying systems.
- Use the Service for any commercial purpose without our written consent.
Violations may result in content removal, account suspension or permanent termination, at our sole discretion.
6. Intellectual Property Rights
The Service, including its software, design, brand, text, graphics and trademarks, is owned by DatsTheOne or its licensors and is protected by intellectual-property laws. Certain features and components of our products are currently Patent Pending with the Canadian Intellectual Property Office (CIPO) and/or foreign patent authorities. Users are strictly prohibited from reverse-engineering, copying, or replicating any patent-pending or proprietary technologies found on this site.
We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for personal, non-commercial purposes.
You retain ownership of the content you submit (photos, bio, messages). By submitting content, you grant us a worldwide, royalty-free licence to host, store, reproduce and display it strictly as needed to operate and improve the Service.
7. Termination of Services
You may close your account at any time from your account settings. We may suspend or terminate your access, with or without notice, if you breach these Terms, create risk for other members, or if required by law. Upon termination, your right to use the Service ceases immediately; sections that by their nature should survive (intellectual property, liability, governing law) will continue to apply.
8. Limitation of Liability & Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not guarantee compatibility, the conduct of members, or specific relationship outcomes.
To the maximum extent permitted by law, DatsTheOne and its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the Service. Our aggregate liability for any claim will not exceed the amounts paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
9. Governing Law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Montréal, Québec, unless mandatory consumer protection laws provide otherwise.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. The "Last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
